Obama’s War on Libya vs the U.S. Constitution

With military action taking place in Libya right now, the essential question must be asked: Is it even Constitutional? For those of you who don’t want to read more than a sentence or two, here’s the short answer. Absolutely not.

Delegated Powers

The ninth and tenth amendments, while they didn’t add anything new, defined the U.S. Constitution. In short, they tell us that the federal government is only authorized to exercise those powers delegated to it in the American Constitution… and nothing more. Everything else is either prohibited or retained by the states or people themselves.

What does this have to do with Libya? Well, whenever the federal government does anything, the first question should always be, “where in the Constitution is the authority to do this?” What follows here is an answer regarding American bombs being dropped on Libya.

Who Decides?

Ever since the Korean War, Article II, Section 2 of the Constitution has been regularly cited as justification for the President to act with a seemingly free reign in the realm of foreign policy – including the initiation of foreign wars. But, it is Article I, Section 8 of the Constitution that lists the power to declare war, and this power is placed solely in the hands of Congress.

Article II, Section 2, on the other hand, refers to the President as the “commander-in-chief of the army and navy of the United States.” What the founders meant by this clause was that once war was declared, it would then be the responsibility of the President, as the commander-in-chief, to direct the war.

Alexander Hamilton clarified this when he said that the President, while lacking the power to declare war, would have “the direction of war when authorized.”

Thomas Jefferson reaffirmed this quite eloquently when, in 1801, he said that, as President, he was “unauthorized by the Constitution, without the sanction of Congress, to go beyond the line of defense.”

In Federalist #69, Alexander Hamilton explained that the President’s authority:

“would be nominally the same with that of the King of Great Britain, but in substance much inferior to it. It would amount to nothing more than the supreme command and direction of the military and naval forces, as first general and admiral of the confederacy; while that of the British king extends to the declaring of war, and to the raising and regulating of fleets and armies; all which by the constitution under consideration would appertain to the legislature.”

James Madison warned us that the power of declaring war must be kept away from the executive branch when he wrote to Thomas Jefferson:

“The constitution supposes, what the history of all governments demonstrates, that the executive is the branch of power most interested in war, and most prone to it. It has accordingly with studied care vested the question of war in the legislature.”

Words have meaning

If, like any legal document, the words of the Constitution mean today just what they meant the moment it was signed, we must first look for the 18th Century meaning of the words used. Here’s a few common 18th-century definitions of the important words:

–War: The exercise of violence against withstanders under a foreign command.
–Declare: Expressing something before it is promised, decreed, or acted upon.
–Invade: To attack a country; to make a hostile entrance

What does this all mean? Unless the country is being invaded, if congress does not declare war against another country, the president is constitutionally barred from waging it, no matter how much he desires to do so. Pre-emptive strikes and undeclared offensive military expeditions are not powers delegated to the federal government in the Constitution, and are, therefore, unlawful.

How it applies today

Here’s the quick overview of how this all plays out:

* In Constitutional terms, the United States is currently at war with Libya.
* Libya is not invading the United States, nor has it threatened to do so.
* Congress has not declared war. Barack Obama did.

Some would claim, and news articles are already reporting on it, that the 1973 war powers resolution authorizes the President to start a war as long as it’s reported to Congress within 48 hours. Then, Congress would have 60 days to authorize the action, or extend it.

The only question you should have to ask for this would be – “where in the Constitution is congress given the authority to change the constitution by resolution?”

It doesn’t. And that resolution, in and of itself, is a Constitutional violation. More on that in a future article, of course.

James Madison had something to say about such a plan when he wrote:

“The executive has no right, in any case, to decide the question, whether there is or is not cause for declaring war.” [emphasis added]

War Powers resolution or no war powers resolution – without a Congressional declaration, the president is not authorized to start an offensive military campaign. Period.

The bottom line? By using U.S. Military to begin hostilities with a foreign nation without a Congressional declaration of war, Barack Obama has committed a serious violation of the Constitution. While he certainly is not the first to do so in regards to war powers, it’s high time that he becomes the last.

UFOs: Witnesses claim Russian Civil War EBEs

UFOINFO.com — During the Russian civil war in the year 1920 somewhere in the Crimean Peninsula, Ukraine (a Soviet province at the time), a mobile Red Army group was moving along a local road in the rugged mountains of the Peninsula. There were a total of five soldiers including one woman. They were moving in a car wagon and were armed with rifles and “Maksim” machine guns.

They then noticed a lighted area on the side of the road and then stopped near the road, prepared their
weapons and began to check the area. They soon came upon a strange dome-shaped object on the ground and several tall figures walking near the object. The figures were described as dressed in a kind of armored suit, resembling chainmaille. These figures were about 2 metres in height, or perhaps taller.

Thinking that these were foreign enemies, the group prepared to fire upon the strangers with their Maksim machine guns but were suddenly blinded by a bright flash of light and knocked down loosing consciousness. When they regained their senses gain, the object and the strange figures had disappeared.

Iowa witness reports UFO

An Iowa witness traveling south along I-35 at 5:54 a.m. on March 22, 2011, watched a silent, black triangle-shaped object under 300 feet that appeared to be constructed of “black, dull composite fiberglass,” according to testimony from the Mutual UFO Network (MUFON) witness reporting database.

The witness was driving between mile marker 61 and 62 at the time. The MUFON report was filed on March 22.

“The craft was about 300 feet above the tree tops and flying very slow as if on a landing approach,” the witness stated. “It had non-blinking white lights on the ends of each tip of what at first look like wings and had two very large spotlights where the nose landing wheels should be, but the flood lights were not spotting forward like normal airliners. This was my first indication this was not a normal jetliner.”

As the object approached the highway, it turned off lights and banked hard away from the roadway.

“As the craft slowly approached I-35, about 200 feet before the craft would had crossed over Interstate 35 and over me, the craft quickly turned off the forward flood lights and made a hard bank right turn away from the highway (as if the pilot was saying ‘Opps! Wrong runway!’). When it banked I could see it was not a passenger airliner but a black triangle shaped Flying Wing with a boomerang shape leading edge.”

The witness described the object and its lack of sound.

“I would say it was a very large craft with a 250 to 300 feet wing span and about 325 to 350 feet long. The structure was not made from metal but more like a black, dull composite fiberglass. It slowly flew away at a 45 degree angle northeast and I could see it had no vertical stabalizer nor any exhaust or sound from any engines. The side white marker lights never turned off but now I could see a set of red anti-collision light blinking off-center to the right of the Flying Wing as it flew away.”

Iowa is a current UFO ALERT 5 rating, with a low number of UFO sightings nationally. Iowa had 1 UFO report in February 2011 – while California had 67 sightings, the highest reporting state in the nation.

IA, March 22, 2011 – Lost Black Flying Wing Faking as Passenger Jetliner. MUFON Case # 28355.

Between mile marker 61 and 62 south of Des Moines, Iowa and north of Iowa/Missouri State line where I am driving south on Interstate 35. I noties low level lights of what at first look like a approching passenger airline flying low from a southeast flight path and heading northwest at a 45 degree angel north to Interstate 35.

The craft was about 300 feet above the tree tops and flying very slow as if on a landing approch. It had non-blinking white lights on the ends of each tip of what at first look like wings and had two very large spot lights where the nose landing wheels should be, but the flood lights were not spoting forward like normal airliners. This was my first indication this was not a normal jetliner.

Canadian MP’s are Complicit in Crimes Against Humanity

Today I read in a local small paper that the vote in our Parliament for Canada to “invade” Libya was UNANIMOUS. So much for an existence of any humanitarian in our Parliament! Hiding behind the euphemism of a no fly zone while you dump depleted uranium is still invasion.

As with the Croation/ Serbian invasion by Canada, so with Libya, each and every Canadian Parliamentarian has blood on his/her hands. They have a blot indelibly scarred into their foreheads behind which their brains have shrivelled and their hearts have scorched as if in sympathetic reaction to the effects of the depleted uranium they are now dropping on the Libyans and the Middle East .
They are committing crimes against humanity.

To watch our Prime Minister gloating about collateral damage with a face full of pompous arrogance and savage delight in running with the “big boys” was sickening. And now a unanimous parliament!!

I will never understand nor condone the weakness at best and the evil at worst of each and every elected representative at whatever level of government who fails us and all of humanity so miserably; who is so incapable of facing the truth; who is so unwilling to confront the power of the world. They are not only useless to us, useless to the world, and useless to themselves, they are agents for the criminals.

It is time for the mass to emerge moving in unison, silent, peaceful to take back Parliament by mental and emotional energy in a surge of spiritual power!

One thing is certain. Any one of us who votes this coming federal election for any incumbent member or party will be complicit by that vote in perpetrating crimes against humanity.

Even though our electoral system has deteriorated to being the instrument that delivers us to the evil powers of the world, and so long as that system is still in place, we still must not refuse to vote. We must seek out any independent or candidate for any party currently not represented in Parliament, provided that candidate commits to an end to participation in war, an end to servility to the USA, and a refusal to accept or promote the New World Order. That effort will energize the general consciousness propelling us to a noble way of being- a way of love, compassion, and peace.

Here is a specific way to be doing something. No need for any mass organization. Just each of us listening to and following our inner guidance; each of us saying no in the myriad of ways, from no to a vote for incumbent parties to no to the infiltrators who will try to co-opt our heart and mind.

Our conscience remains the guide. Our parliamentarians have abandoned theirs. But, their consciences can be salvaged! We can catalyze the good in not only our own souls, but theirs

Individuals who like to play bingo in Canada may be interested to know an Edmonton gaming establishment has obtained a liquor licence.

The Fort Road club has started serving alcohol to its patrons, in a move that is designed to regain some of the customers that have been lost due to the emergence of casino games, the Edmonton Sun reports.

General manger of the venue John Wanless noted he is very encouraged by how the scheme is working so far.

“We need to offer our players more. The bottom line is that we are at a competitive disadvantage and there’s so much competition for the entertainment dollar,” he added.

It means bingo fans now have the opportunity to have a sociable drink with their friends as they take part in the pastime.

Susan Moore, bingo manager of Parkway Bingo, told the news provider she is watching the developments at the Fort Road with a close eye, as her own premises may consider taking similar action if it proves to be successful.

A Pennsylvania witness reports a double UFO sighting on October 7, 2010, while driving along I-81 south from the Paxtonia area, where a large triangle object was spotted, and closer to Enola, six cigar-shaped objects were seen flying in a circular motion, according to testimony from the Mutual UFO Network (MUFON) witness reporting database.

The first encounter was early evening before the sun had gone done near the 81-83 split when the triangle-shaped object was seen.

“It was an elongated triangle, sharply pointed at one end with three points at the other end,” the witness stated. “It was pointed straight up and moving that direction at what seemed to be a moderate pace. It appeared to be white in color except for an area just below the center where it was glowing yellow-orange. I could see what appeared to be condensation streaming down it’s length starting about 1/4 of the way down from the pointed end. The condensation obscured any details of its surface until it reached the glowing section. The condensation ended there, which I took to indicate that the glowing area was very hot.”

The witness briefly lost sight of the object, and determined that the object had simply disappeared.

But further along south along I-81 near Enola, the witness noticed six cigar-shaped objects in the sky.

“They were silver-gray in colour and fairly low in the sky. They appeared to be much smaller than the other UFO, but were still larger than anything else I could see in the sky. Some were oriented horizontally and some were rotated about 45 degrees from horizontal and they all appeared to be flying sideways, with their entire length pushing through the air. They left no con-trail and there was no sound that I could hear. No lights were visible.”

UFO: South Dakota Security officer describes encounter

A South Dakota Sioux Tribe security officer reported that hundreds of softball-sized red lights spun around his vehicle while driving home from work March 6, 2011, and that he had an encounter with two “translucent ” beings, according to testimony from the Mutual UFO Network (MUFON) witness reporting database.

The man’s wife filed the MUFON report March 7 after her husband returned home “visibly shaken” and apparently with missing time. The wife stated that the drive home from the casino usually takes 90 minutes, but that the events began around 11:15 p.m. and her husband arrived home at 2 a.m.

The man was driving alone in his vehicle when he noticed the red lights about 11:40 p.m. on Highway 63 about five miles south heading into Eagle Butte.

“The red lights, about 100-200 of these red lights, kept going around the car for a couple of miles,” the witness stated. “They never got super close, like two car lengths away from me, but all around me.”

A few miles down the highway, the man noticed that his car was slowing down.

“I was doing about 60 mph, but it slowed down to 40 mph, and wouldn’t go any faster. Then the red lights just disappeared. They didn’t fly off or anything, they just disappeared. The car then went back up to 60 mph like I normally drive it.”

When Highway 63 met a gravel road near a wind block experimental station, he noticed something standing along the road.

“I got a feeling of goosebumps all over me. It was tingly cold feeling all over me. Then I saw this thing on the side of the road where the gravel road meets the road and before I knew it, it was on the car. It reached in and touched my head through the windshield and ran its hand down my back. My back got real hot.”

The man described the alien.

“It had an oblong head, really thin body, thin arms and legs. It was translucent. It was glowing like a real dim light bulb cause you can see through it. Eyes were size of human, really long nose long in length. It has a really big mouth. Its arms were like sticks. They were parallel through each other. The two sticks looked like it was glowing. It was around 4 foot tall, but its arms stretched.”

There was another being standing along the road too.

“The other one, on the left hand side of the road had a face like a beast, horrifying, ugly, looked wrinkly, walked like a squat about the size of a goat. It was glowing too, reddish brown. It was wide and narrow.”

The being along the side of the road disappeared quickly, but the alien that appeared to enter the car stayed with the man until he reached an area where there were homes.

The wife said her husband’s head was hot and his demeanor was agitated when he arrived home. The husband also noticed that he had used up more gas than usual.
